de Verges & Katsonis is a small full service law firm with a national clientele.    Founded in 1998 by two former Federal Deposit Insurance Corporation attorneys, George L. de Verges and Nicholas Katsonis, the firm represents individuals, banks, businesses, and government agencies in State and Federal Courts across the Commonwealth of Massachusetts.

Our practice areas:

Litigation:  de Verges & Katsonis handles general civil litigation, including debt collection, lien enforcement, contract disputes, lender liability claims, and fraud claims.  Our attorneys regularly appear in district and superior courts in all counties of central Massachusetts.

We have more than two decades of experience in bankruptcy-related litigation, having been on both sides of automatic stay and adequate protection disputes, preference and fraudulent conveyance litigation, and plan confirmation objections.

Because we represent clients from different regions of the nation, our practice also frequently takes us to the United States District Court in both the eastern and western divisions of Massachusetts.

Bankruptcy:  de Verges & Katsonis has an active Chapter 11 practice.  We also handle cases under Chapters 7 and 13 of the Bankruptcy Code.

We pride ourselves on standing by our clients and guiding them from the traumatic period before bankruptcy to the successful exit.  Bankruptcy provides valuable tools to restructure loans, shed burdensome contracts and leases, recover ill-advised transfers, and eliminate unsecured debts.  Our attorneys possess the experience to make the most of every available tool.

Transactions:  de Verges & Katsonis' transactional practice falls into three categories:  (1) the purchase and sale of commercial real estate; (2) the purchase and sale of secured debts; and (3) general business transactions.

de Verges & Katsonis provides aggressive representation at a reasonable cost.  We carefully listen to our clients, work diligently to determine and fulfill their needs, and make every effort to ensure that each client receives the best service possible.  Please call for more information.

Frequently Asked Questions - Bankruptcy Chapter 11:

Will a trustee take over my business?  No, in most chapter 11 cases the debtor retains possession of and control over the assets and continued to manage the business as a "Debtor-in-Possession."  Nonetheless, you must file monthly operating reports with the Office of the United States Trustee and receive bankruptcy court permission before selling assets (except in the ordinary course of business), obtaining credit, or employing professionals such as attorneys and accountants.

I have a supplier that I need to continue doing business with.  Can I pay his bill?  Just as the bankruptcy laws prevent a pre-bankruptcy vendor from pursuing collection after you file, you, the chapter 11 Debtor-in-Possession, are prohibited from paying most pre-bankruptcy debts until the court approves a plan of reorganization.  Exceptions to this general rule relate to leases and secured debts.  Also, the bankruptcy courts will often approve payment of a limited amount of pre-bankruptcy wages and employee benefits.
